Terms of Service

The terms that govern your use of the Anvil Software website, including what happens to the project details you send us through our contact form.

1. Who these terms are between

This website is operated by Anvil Software LLC, a Colorado limited liability company based in Denver, Colorado. Throughout these terms, "Anvil Software", "we", "us" and "our" mean Anvil Software LLC, and "you" means the person or business using the site.

By browsing this website or sending us anything through it, you agree to these terms. If you do not agree with them, please do not use the site.

2. Changes to these terms

We may update these terms from time to time. The date at the top of this page tells you when they were last changed in a meaningful way. Continuing to use the site after a change means you accept the updated terms, so it is worth a look if you have not been here in a while.

3. This site is information, not an offer

Everything on this website — service descriptions, timelines, the price ranges in our FAQ, the Anvil Care Plan outline — is published to help you work out whether we are a good fit. None of it is a binding offer, a quote, or a commitment to take on your project.

Actual work is governed by a separate written scope and quote that we prepare for your project and that both of us agree to. If anything in that signed agreement conflicts with anything on this page, the signed agreement wins. Nothing here changes, limits, or adds to what you have signed with us.

4. Who may use this site

This site is aimed at businesses, and sending us an inquiry is a commercial act. You may only submit our contact form if you are at least 18 years old and are acting for yourself or on behalf of a business you have authority to represent.

The site is not directed at children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has sent us information through this site, contact us at erik@anvilsoftware.io and we will delete it.

5. No accounts

You do not need an account to use this website, and we do not offer visitor accounts. The login area of this site is for our own staff.

Because there is no account, you are responsible for what you send us in each submission, and for keeping your own copy of anything you would want to refer back to. We are not able to retrieve a form you started and did not send.

6. Acceptable use

You are welcome to read this site, share links to it, and get in touch. You agree not to:

  • use the site for any unlawful purpose, or in a way that breaches anyone else's rights

  • submit content that is illegal, that infringes anyone's intellectual property, privacy or publicity rights, or that promotes violence, harassment or hate

  • attempt to gain unauthorized access to the site, its server, or any connected system

  • probe, scan, or test the vulnerability of the site, or interfere with its normal operation

  • use automated tools to scrape, harvest, or bulk-collect content or contact details from the site

  • send us anything through our forms that contains malware, or that you know to be false or misleading

  • submit someone else's personal information without the standing to do so

We may restrict or block access to the site if we reasonably believe it is being used in any of these ways.

7. Our content and brand

The text, layout, design, graphics, and the Anvil Software name and mark on this site belong to us or are used with permission, and are protected by copyright and trademark law. You may read the site, print pages, and quote short passages with attribution and a link.

You may not copy the site or substantial parts of it, republish our content as your own, or use our name or mark in a way that suggests we endorse you or are connected with you, without our written permission first.

To be clear about the thing that matters most here: this section is about the marketing website, not about project work. When we build software for you, you own it — the code, the repository, the database and the hosting accounts — on the terms set out in your signed agreement.

8. What you send us through this site

Our contact form asks for your name, email address, company, budget and timeline, and a description of your project. We use that information to respond to you, to prepare a quote, and to keep in touch about your inquiry. How we store and handle it is set out in our privacy policy.

What you send stays yours. You keep ownership of everything you submit, and you grant us only a limited, non-exclusive license to use it for the purpose you sent it for — reading it, replying to it, and preparing a quote. We do not sell it, publish it, or pass it to anyone else except the service providers that help us operate the site and our email, and we do not use it to train AI models. You confirm you have the right to send us whatever you submit.

If you need to discuss something sensitive, ask and we will put an NDA in place before you send it. It is a normal request and we are happy to. Short of that, please treat an inquiry as a first conversation rather than a confidential disclosure: until we have a signed agreement or a non-disclosure agreement in place, information you send through this site is not received in confidence and does not create a confidential relationship between us.

We also work across many businesses in similar industries, and we retain the general skills, experience and know-how we develop. Nothing in this section stops us from working with other clients, including in your sector.

If you send us an idea, suggestion, or feedback about our own business or website, you agree we may use it without owing you payment or credit. This does not apply to information about your business or your project.

9. No professional advice

The content on this site is general information about what we do. It is not technical, legal, financial, or professional advice for your particular situation, and you should not act on it without talking to us or another suitable adviser about your specific circumstances.

10. Links to other sites

This site may link to websites we do not control. We include those links because we think they are useful, not as an endorsement. We are not responsible for the content, accuracy, or practices of any third-party site, and visiting one is at your own risk under whatever terms that site sets.

11. Availability and accuracy

We work to keep this site accurate and available, but we provide it "as is" and "as available". To the fullest extent permitted by Colorado law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that the site or its server are free of harmful components. We may change, suspend, or withdraw any part of the site at any time without notice.

This section is about this website only. Warranties covering software we build for you are set out in your signed agreement, and nothing here limits them.

12. Limitation of liability

To the fullest extent permitted by Colorado law, Anvil Software and its members, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of this website, or for any loss of profits, revenue, data, business, or goodwill, whether the claim is brought in contract, tort, or on any other basis, and whether or not we were advised such damages were possible.

Our total liability to you for all claims arising out of or relating to this website will not exceed one hundred United States dollars ($100).

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited, including for fraud or fraudulent misrepresentation. Liability for project work is dealt with separately in your signed agreement.

13. Indemnity

You agree to indemnify and hold harmless Anvil Software and its members, officers, employees and contractors from any claim, demand, loss, or reasonable legal cost arising out of your breach of these terms, your misuse of the site, or your violation of any law or third-party right in connection with your use of the site.

14. Privacy

Our privacy policy explains what personal information we collect through this site, why we collect it, how long we keep it, and what choices you have. It forms part of these terms, and using this site means you accept it as well.

15. Blocking access, and what survives

We may restrict, suspend, or block your access to this site at any time if we reasonably believe you have breached section 6, without needing to notify you first.

If your access ends, for any reason, the sections that by their nature should outlast it continue to apply — in particular our content and brand (7), what you send us through this site (8), availability and accuracy (11), limitation of liability (12), indemnity (13), governing law (16), and this section.

16. Governing law and where disputes are heard

These terms and any dispute arising out of them or out of your use of this website are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules.

You and we agree that the state and federal courts located in Denver County, Colorado have exclusive jurisdiction over any such dispute, and you consent to those courts hearing it.

17. General

If any part of these terms is found to be unenforceable, that part will be limited or removed to the minimum extent necessary and the rest will remain in full force. If we do not enforce a right under these terms straight away, that is not a waiver of it.

Together with our privacy policy, these terms are the entire agreement between you and us about your use of this website. They do not replace or vary any separate written agreement covering work we do for you.

You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours to a successor in connection with a merger, acquisition, or sale of our business.

Copyright complaints: if you believe something on this site infringes a copyright you own or represent, send a notice to erik@anvilsoftware.io with the subject line "DMCA notice". Please include enough for us to act on it:

  • identification of the copyrighted work you say has been infringed

  • identification of the material on our site you want removed, with the URL where we can find it

  • your name, postal address, telephone number and email address

  • a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law

  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them

  • your physical or electronic signature

We will investigate and remove or disable access to material we determine to be infringing. We may also terminate access for repeat infringers.
